In wrongful death cases, the only individuals who really have a claim is the surviving spouse and/or children of the decedent. In some instances the parents of the decedent if he or she was not married and did not have children would also have a potential claim. Unfortunately, in the state of Colorado if the decedent left no children and had no spouse at the time of death and the siblings are not entitled to damages for wrongful death.
In Colorado there's a 2 year statute of limitations in wrongful death cases meaning that the claim would have to be brought within 2 years from the date of death, otherwise it will be forever barred.
In Colorado there's a cap meaning a ceiling on the amount of damages you can recover in a wrongful death case.
Wrongful death can come about as a result of many circumstances that include
but are not limited to auto accidents, professional malpractice, or just general
negligence on the part of someone.
